Artsy helped me with a problem regarding an incorrect image of my art

Reviewed on 2021-05-07T15:23:02

I had a long term problem regarding an image of my art, which was not representative of my work.It kept coming up in the search engines when I searched for my page on Artsy. The color was wrong. It had been photographed by someone else.... The Artsy representative was very helpful. She understood, and she and her team worked to find where the source of the problem was. She was patient with me, and they were able to find and delete the image, and resolve the problem.

THIS COMPLAINT REMAINS LIVE

Reviewed on 2021-04-29T22:35:11

THIS COMPLAINT REMAINS LIVE. I have still not been fully refunded. ----------------------------------------------------------- Ihave found Artsy relaxed about fakery and misrepresentation on their platform. My purchase turned out to be not as advertised, and I am still awaiting redress. I bought what was as advertised as an original, unique painting, by an artist whom I respected at the time. A week after delivery, I discovered by chance that it was neither original nor unique. It was actually a direct reproduction of another artist’s work, passed off as original, with no attribution. I made enquiries with the original artist; affronted, they promptly referred the plagiarism to a copyright lawyer. It turned out that Artsy's gallery knew the painting was a copy; but, whether by negligence or fraud, had chosen not to disclose this in their advert. WARNING: Artsy allow their sellers to doctor advertisements AFTER a sale has taken place. As soon as I raised a query, the gallery added a disclaimer about image rights, even though the item was by then marked "Sold". They then refused further contact, and referred me to Artsy’s customer service team. They in turn rejected my complaint, claiming the doctored advert, with the added disclaimer, was the one that applied. Artsy put the onus on me to prove that the listing had been changed. I showed them a screenshot of their original ad, sans disclaimer, but they dismissed this as I could not prove to Artsy's satisfaction the date the screenshot was taken. Artsy proceeded to fob me off with various get-out clauses in their fine print. For example, they refused to investigate the mis-selling because I had reported it 8 days after delivery, not 7. They summarily closed the incident when I mentioned I had made a trivial adjustment to the back of the painting’s frame, because they do not accept returns of ‘altered merchandise’ - whether or not it had been sold by deception. It was only when I put the prima facie fraud to Artsy’s chief executive, by private email, that they bothered to investigate, and eventually accepted that the sale needed to be reversed. This took weeks to arrange, and is still unresolved. Multiple errors in basic shipping documentation suggest to me that Artsy do not know what they are doing, or much care. For example, a missing Declaration of Authenticity resulted in me incurring EU import duty at 29% instead of 6%. I find I cannot reclaim this cost because, although the sale was annulled, and despite Artsy’s advertised returns policy, their shipper had declared it non-returnable. Artsy continue to blank my requests for reimbursement, leaving me significantly out of pocket. I have no reason to think that the copy won’t be put back on sale on Artsy's site under the same misleading prospectus with which it was mis-sold to me. Artsy are either unable or unwilling to give me assurances on this, despite repeated requests. I dislike giving negative reviews, but do this for the protection of other collectors.

This site will open a lot of pop-up windows to make your life miserable. Of course, they think that these are helpful features, not annoyances. These guys have no respect for users. So, don't bother with them. Companies like this just burn VC money, close doors, re-open under different website, raise VC money again and burn it, and so on..
