I spent about a month bending over backwards to try to open an account with this bank.I was very impressed with the first agent who took my call, he was very well informed and professional. I explained I was not in Poland and needed to authorize a lawyer under a power of attorney to open the account. He explained the process was very straightforward: sign a power of attorney for the lawyer before a notary, send it to the lawyer, together with a certified copy of your passport, and the lawyer can go into a branch and apply for an account for you. I expressly asked and he expressly confirmed that an English language notary was acceptable. However, once I paid a law firm to follow the process, the story all changed. The next person at the bank said an English language notary was not acceptable, it had to be a Polish notary. But under Polish law, a Polish notary can only notarize things if you visit them in person, in Poland - notarization via a video conference is not permitted. Did anyone listen when I mentioned that I was not in Poland, and couldn't get to Poland? If I was able to go to Poland, why do I need a lawyer or a PoA at all? Then the story changed again - the notarization has to be performed either by a Polish notary or by a Polish consular officer. Never mind that I can't get to a Polish consulate either - a Polish consulate will only provide this service to Polish nationals (I did call them to check). Then the bank changed the story yet again: we can use an English notary after all, provided we get an apostille and use an official translation to translate it into Polish. Does the signature on the PoA need to be original, does the notarization need to be original, does the apostille need to be original, or do scans work? It makes a huge difference: due to the coronavirus, everyone will be communicating by video conference, with scans, it can all be done in a day, at the other extreme, if every signature has to be original, it will take a month or maybe two while originals are shipped back and forth - even if just one signature can be a scan it will save a lot of time and money. We do really need a clear answer before we embark on this. No one at the bank could give a straight answer: not to me, nor to the lawyer, who is locally based in Poland. Actually, it's worse than that: you do get a straight answer, but when you follow the instructions given, the next person you talk to gives you the opposite answer and wants something completely different. Then I arranged for an officer at the branch who would actually handle the opening of the account to call me or my lawyer to tell us what that very person who made the final decision on the ground actually wanted. It was all arranged, but no one ever called back. It doesn't say much for reliability of the institution, indeed on the whole, the bank has acted rather unreliably. Worst of all, the required wording on the PoA changed half way through the process as well: at first, I authorized the lawyers to open a bank account for me - nothing else. But the bank then required me to authorize the lawyers to open, close, and operate the account as they pleased, including making any withdrawals they wanted in order to open the account. Why would that be necessary? I'm not authorizing the lawyers to do all that. Also, think about it: you sign a PoA, spend a ton of money to have it notarized, apostilled, translated, it takes two months to ship originals back and forth, and then the bank says the wording of the PoA needs to be slightly different. Two months down the line, and back to square one. It all ended with me spending a ton of money on lawyers and the bank saying "opening a bank account in a case like yours in principle it should be possible, but may be fraught with certain logistical and organizational difficulties, and it will certainly require a considerable amount of time". And I and my lawyers still don't have the answer to the simplest question as to what the process of applying for an account actually is. In other words, I don think they really want the business. Why not just say so in the first place?
